Water Taxi CI Booking Terms & Conditions

1. Definitions

• “Company” refers to the boat charter operator providing the service Go-Sail.je.
• “Charterer” / “Client” refers to the person or party making the booking.
• “Vessel” refers to the boat used for the charter.
• “Skipper/Crew” refers to Company-approved personnel operating the vessel.

2. Booking & Payment

1. A booking is only confirmed once the Company has received a deposit (typically 50%) or full payment as specified at the time of booking.
2. The remaining balance must be paid no later than [1 week] before the scheduled charter.
3. If payment is not received by the deadline, the Company reserves the right to cancel the booking without refund of the deposit.
4. The person making the booking accepts responsibility for ensuring all passengers comply with these terms.

3. Cancellations & Refunds
​By the Client

1. Cancellations must be made in writing.
2. Refund schedule (example):
   • More than 30 days before charter: Full refund minus admin fee
   • 15–30 days: 50% refund
   • Less than 14 days: No refund
3. No refund is provided for late arrival, no-shows, or unused time.

By the Company

1. The Company may cancel or alter charters due to unsafe weather, mechanical issues, or other operational reasons.
2. In the event of cancellation by the Company, clients will receive either:
   • A full refund, or
   • A rescheduled date (subject to availability)
3. The Company is not liable for additional costs incurred by the client (travel, accommodation, etc.).

4. Weather Conditions

1. The Skipper has sole authority to determine if conditions are safe for departure. The company will endeavour to inform the client a minimum of 24 hours before the departure time. 
2. Weather cancellations are based on safety, not on client preference.
3. If adverse weather forces an early return, a partial refund or pro-rata adjustment may be offered at the Company’s discretion.

5. Safety & Conduct

1. All passengers must follow instructions given by the Skipper and crew at all times.
2. The Company reserves the right to:
   • Refuse boarding to any person under the influence of drugs or alcohol
   • End the charter early if passenger behaviour compromises safety
3. All passengers must inform the Company of any medical conditions or mobility issues prior to departure. 
4. Lifejackets must be worn when instructed.

6. Liability

1. Passengers participate at their own risk.
   
2. The Company accepts no liability for:
   
   • Loss or damage to personal belongings
     
   • Injuries resulting from passenger negligence or failure to follow instructions
     
3. The Company maintains full public liability and vessel insurance.
   
4. The Charterer is liable for any damage caused to the vessel due to negligence or misuse by passengers.
   

7. Alcohol & Catering

1. Alcohol may only be consumed in moderation and in accordance with the Skipper’s instructions.
   
2. The Company may prohibit alcohol based on safety conditions.
   
3. Glass bottles or breakable containers may be restricted onboard.
   

8. Itinerary & Schedule

1. All trip durations, routes, and destinations are approximate and may change due to tides, weather, or operational requirements.
2. Delays caused by late client arrival will not extend the charter time.

9. Photos & Media

1. The Company may take photos or video during the charter for promotional use.
   
2. Clients should notify the Company in writing before departure if they do not consent to this.
   

10. Age Restrictions

1. Children under [16] must be accompanied by an adult at all times.
2. The Company reserves the right to decline infants or very young children if conditions are unsuitable.

11. Governing Law
​ These Terms & Conditions are governed by the laws of Jersey, Channel Islands and any disputes shall be handled by the courts of that jurisdiction.

However, Client records are regarded as confidential and therefore will not be divulged to any third party, other than if legally required to do so to the appropriate authorities. Clients have the right to request sight of, and copies of any and all Client Records we keep, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Client’s with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.
We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.

Force Majeure
